The world trading system is threatened by the seemingly acceptedproliferation of discriminatory trade agreements and discriminatory use of trade policy. While muchattention has been drawn to the most overt of these policies, DTAs such as CUSFTA and NAFTA, otherexamples of discriminatory treatment are equally worrisome, perhaps because they are so *** include the imposition of country-specific anti-dumping measures and the China-safeguardpolicy, and even the implicitly discriminatory impact of the seemingly non-discriminatory tradepolicy of a global safeguard, if it is applied in just the 'right' way. Furthermore, there isincreasing evidence that concern for the stumbling-block effects of DTAs are well-founded - *** the formation of DTAs both encourage additional discriminatory behaviour reinforcing theinitial pattern of discrimination and discourage non-discriminatory multilateral tradeliberalisation. As non-discrimination in the form of most-favoured-nation treatment is one of thefundamental pillars of the GATT/WTO system, the proliferation of explicit and implicitdiscriminatory trade-policy actions threatens to reverse the gains that have been achieved throughnearly 60 years of multilateral negotiations and cooperation.
